It seems like it would be illegal. All music is copyrighted by the original artist and the record label get royalties from sales.
Most CDs have some message similar to this one from a Philips CD.
"All rights reserved. Unauthorized copying, reproduction, hiring, lending, public performance, and broadcasting prhibited"
I would think the "Public Performance" bit would answer your question. However, does anyone know of anyone getting sued for using music at a recital? My guess is that it would be too much trouble for the recording labels to bother.

Technically, you should pay royalty fees. ASCAP can give you more info on this, however, I don't think you would get sued for using music in a dance recital.

Interesting. I just took a look at the ASCAP web site and I couldn't find information about pricing but they do have license agreement forms.

Even if you have music playing on your web site, technically you're supposed to have a license and pay royalties too.
Has anyone looked into this further? Anyone got licenses for their performances or recitals?

Although I am not a copyright attorney, I have experience working with dancing schools and night club owners. To my understanding, a flat yearly fee can be paid to BMI & ASCAP for the use of their tunes in dancing schools. Assuming that this is true, you might research this further, as it might be an option for you. When I work with dancing schools to create custom video/audio editing for auditions/recitals, I ask the school owner to sign a simple statement specifying that he/she has paid the royalty fees. I hope this helps.
